The Covestro LLC U.S. Privacy Notice (“U.S. Privacy Notice”) is a regional supplement to our Privacy Statement for individuals located in the United States. Our U.S. Privacy Notice and our Global Privacy Statement describe the types of information we may collect from you or that you may provide when you visit Covestro.com and our practices for collecting, using, maintaining, protecting, and disclosing that information.

The U.S. Privacy Notice applies to information we collect on the Covestro Website and in email, text, and other electronic messages between you and the Website. Visit our U.S. Covestro website.
The U.S. Privacy Notice does not apply to information collected by us offline or through any other means, including on any other website operated by Covestro or any third party (including our affiliates and subsidiaries); or any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or through the Website. The U.S. Privacy Notice does not apply, or to our collection and use of personal information in an employment capacity. Employees, job applicants, contractors, interns, or other workers seeking more information our employment-related personal information policies and practices should contact the respective Covestro representative.
User Information Collected
We collect certain information as described in this U.S. Privacy Notice and our Global Privacy Statement. The type of information from and about users of our website varies, however, you can use Covestro's website without providing any personal data to us. Some offers and services available on our websites, however, do require personal information to access. We may obtain information directly from you if you choose to provide it, through passive online interactions with our website, through business relationships, or from publicly available sources. You can use Covestro's website without providing any personal information to us.
We may collect information from you in different ways and for different purposes. The types of information we collect will depend on your interaction with us, including the types of products or services you use and what you do on our website. Further, your personal information will be deleted or blocked as soon as the purpose for the storage no longer applies and the storage is no longer necessary to comply with regulatory requirements, usually for the duration of the respective contractual relationship, including any applicable statutory retention period. Information You Provide. You can use Covestro's website without providing any personal information to us. Some offers and services available on our other websites, however, do require personal information to access. Other personal information is only collected if you provide it to us, for instance by filling out a form, sending e-mails, while placing an order for services or products, or while making an inquiry or requesting materials. This also includes customer surveys that Covestro sends out several times a year, subject to their consent.
- Registration on our websites (if applicable): If you take advantage of the opportunity to register on our website and provide us with personal information, data entered into the input fields will be transmitted to the entity responsible for processing it. When a user registers on our website, their IP address and the date and time of registration are saved. The purpose of this is to prevent misuse of services. Data must be registered to provide content or services. Registered persons may delete or amend their saved data at any time. Affected persons may obtain information on their saved personal information at any time.
- Contact Forms: Our website includes a contact form that can be used to contact us electronically. If you choose this option to contact us, personal information you provide will be saved automatically. Data is saved only for the purpose of processing or contacting the person in question. Alternatively, you can also contact us at the provided telephone number or in writing via the provided address.
- Newsletter: If you subscribe to our company newsletter, the data you enter in the input fields will be submitted to the entity responsible for data processing. When a user registers for our newsletter, their IP address and the date and time of registration are saved. This is done to prevent a misuse of services or misuse of the individual’s e-mail address. Data is never transmitted to third parties, except if we are required to transmit such data by law. This data is only used to send the newsletter. The affected person can cancel their newsletter registration at any time. They can also revoke their consent to have their personal information saved at any time. A link is provided in each newsletter for this purpose.
Information Collected Automatically. When you visit our website, Covestro uses an automated system to collect data and information. However, this information is not associated with any individual for the purpose of assessing their behavior. Data is processed to deliver the content of our website, to ensure the functionality of our IT systems, and to optimize our website, as well as to protect our justifiable interests and clarify any issues in case of unauthorized access or attempts to access our website.

The Adex. On our website, we use the digital marketing platform “The Adex” from Virtual Minds GmbH (Ellen-Gottlieb-Straße 16, 79106 Freiburg im Breisgau, Germany). In addition to the information provided in our cookie consent tool, you will find the following further explanations of the service. The digital marketing platform “The Adex” is generally used to record information on your user behavior and to provide this pseudonymized data to third-party providers, in order to display usage-based advertisement. We differentiate between the following purposes of processing for The Adex:

- Creating a personalized ad profile

The data processing necessary to fulfill these purposes is carried out only with your consent. In addition to the aforementioned purposes of processing, “The Adex” also performs the following “special purposes of processing” and “functions:”

Information from Third Parties. We may collect user information about you from third party sources, such as public databases, joint marketing partners, social media platforms or other third parties. If you post information about us or engage with us on third party platforms, we may collect user information about you from that third party platform or account. The third-party platforms and services control the information they collect and share about you. Purposes of Collection and Processing
The information provided directly from you is used to fulfill the purposes for which you provide it, for instance by filling out a form, sending e-mails, while placing an order for services or products, or while making an inquiry or requesting materials. We retain your user data for as long as reasonably necessary to fulfill the purposes for which it was collected or as otherwise necessary to comply with our legal obligations, resolve disputes, maintain appropriate business records, and enforce our agreements. Information about our customers is an important part of our business, and we are not in the business of selling user information to others. We share user information only as described below and with our subsidiaries Covestro controls that either are subject to this Covestro U.S. Privacy Notice or follow practices at least as protective as those described in this Privacy Notice. Other than which is set out below, you will receive notice when personal or user information might be shared with third parties and you will be provided the opportunity to opt-out of the information being shared. State Privacy Rights

The exact scope of these rights may vary by state. In addition to the above, Nevada law provides Nevada residents with the right to request that we do not sell your personal information. However, please know we do not currently sell data triggering that statute's opt-out requirements. Further, Delaware law provides residents with a right to obtain a list of the categories of third parties that we have disclosed the respective individual’s personal data.

Exercising Your Rights. To exercise the rights described above, please submit a verifiable consumer request to us by email at DataPrivacyUS@covestro.com or by calling our toll-free number 1-877-229-3778. Consumers may call the phone number provided and an operator will take your information. Covestro will contact you directly to provide more instruction and procure verification information. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of a minor child to whom you are parent or guardian. You may only make a verifiable consumer request for access or data portability twice within a 12-month period.
Verification Process. A verifiable consumer request include sufficient information in response to the website/email/phone verification question asked in the creation of your request that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative of such a person. In the event we need additional information, we will reach out to you personally to ask additional questions. A verifiable consumer request must also describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. Covestro or a third party on behalf of Covestro may follow up with you to determine whether a request is a verifiable consumer request under applicable law.
If we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you, Covestro will deny the consumer request. Covestro will respond to any such consumer request with a denial and will also explain why it has no reasonable method by which it can verify the identity of the requestor.
Response Timing and Format. We will confirm receipt of a verifiable consumer request within ten (10) days of its receipt. We will respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. If you do not indicate a preference for delivery, Covestro will use its discretion in choosing the method for delivery of the information. We do not charge a fee to process or respond to your verifiable consumer request.

Sale or Sharing of Personal Information Under California Law. For purposes of the CPRA, a “sale” is the disclosure of Personal Information to a third party for monetary or other valuable consideration, and a “share” is the disclosure of Personal Information to a Third Party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration. We do not sell the categories of personal information or sensitive personal information we collect or share it with third parties for cross-context behavioral advertising. We do not have actual knowledge that we sell or share Personal Information of California consumers under 16 years of age. However, we may share your personal information with our affiliates and/or service providers in arrangements that may meet the broad definition of “sale” or “share” under the CCPA. In these arrangements, use of the information we share is limited by policies, contracts, or similar restrictions.
California Residents’ Rights. In general, California residents have the following rights with respect to their personal information, subject to some exceptions:
- Right to Request Access to or Deletion of Personal Information: You may have the right under the California Consumer Privacy Act to request information about the collection of your personal information by Covestro, or access to or deletion of your personal information. Once we receive and confirm your verifiable consumer request to delete, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies. We may deny your request to delete if retaining the information is necessary for us or our service providers to complete the transaction for which the information was collected, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you. Other circumstances in which we may deny your request to delete include:
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Debug products to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Comply with a legal obligation.
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
- Right to Request to Know. You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request to know, we will disclose to you:
- The categories of Personal Information we collected about you.
- The categories of sources for the Personal Information we collected about you.
- Our business or commercial purpose for collecting that Personal Information.
- The categories of third parties with whom we share that Personal Information.
- The specific pieces of Personal Information we collected about you.
- If we disclosed your Personal Information for a business purpose, the Personal Information categories that each category of recipient obtained.
- Right to Correct. In certain circumstances, you have the right to request correction of any inaccurate personal information.
- Right to Opt-Out/Do Not Sell Personal Information. We do not sell your Personal Information for monetary or other valuable consideration. We do not share your Personal Information for the purposes of cross-context behavioral advertising. Cross-context behavioral advertising under the CPRA is “the targeting of advertising to a consumer based on the consumer’s personal information obtained from the consumer’s activity across businesses, distinctly-branded websites, applications, or services, other than the business, distinctly-branded website, application, or service with which the consumer intentionally interacts.
- Right to Limit the Use/Disclosure of Sensitive Personal Information. We do not collect sensitive personal information.
- Right to Non-Discrimination We will not discriminate against you for exercising any of your CCPA/CPRA rights. Unless permitted by the CCPA/CPRA, we will not deny you goods or services, provide you with a different level or quality of good or services, suggest that you may receive a different price or rate for goods or services or a different level of quality of goods or services, or charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
Exercising Your Rights. To exercise the rights described above, please submit a verifiable consumer request to us by email at DataPrivacyUS@covestro.com or by calling our toll-free number 1-877-229-3778. Consumers may call the phone number provided and an operator will take your information. Covestro will contact you directly to provide more instruction and procure verification information. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of a minor child to whom you are parent or guardian. You may only make a verifiable consumer request for access or data portability twice within a 12-month period.
Verification Process. A verifiable consumer request include sufficient information in response to the website/email/phone verification question asked in the creation of your request that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative of such a person. In the event we need additional information, we will reach out to you personally to ask additional questions. A verifiable consumer request must also describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. Covestro or a third party on behalf of Covestro may follow up with you to determine whether a request is a verifiable consumer request under applicable law.
If we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you, Covestro will deny the consumer request. Covestro will respond to any such consumer request with a denial and will also explain why it has no reasonable method by which it can verify the identity of the requestor.
Response Timing and Format. We will confirm receipt of a verifiable consumer request within ten (10) days of its receipt. We will respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to an additional 45 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically, at your option. If you do not indicate a preference for delivery, Covestro will use its discretion in choosing the method for delivery of the information. We do not charge a fee to process or respond to your verifiable consumer request.
Requesting Notice in an Alternative Format/Language. You may be able to request this Notice in another language where we provide such notices in the ordinary course of business or in an alternative format if you have a disability. Please contact the Julia DiPasquale below to request an alternative format.
Other California Privacy Rights. California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not share your information with third parties for their direct marketing purposes.
Financial Incentives. Under California law, we do not offer financial incentives to consumers.
Affiliates Providing this Notice. This Privacy Notice for Consumer Residents is provided by Covestro LLC U.S. and its subsidiaries that act as a business within the meaning of the CCPA and CPRA.
